EU AI Act — What Is It?

European Union Artificial Intelligence Act (2024):

  • World's first comprehensive AI law
  • Applies: All companies serving EU users
  • Risk-based approach: High risk → more rules

August 2, 2026: Article 50 (Transparency obligations) live!

4 Key Transparency Rules — Now Mandatory

Rule 1: AI Must Identify Itself

Who: Any AI system directly interacting with humans (chatbots, virtual assistants)

What: Must clearly disclose it is an AI

Examples:

  • Customer service chatbot: "Hi, I'm an AI assistant"
  • WhatsApp Meta AI: Must say "I am an AI" if asked
  • Claude, ChatGPT: Already compliant (mostly)
  • Problem: Bots posing as humans → now illegal in EU

Exception: Authorized law enforcement, obvious artistic context

Rule 2: AI-Generated Content Disclosure

Who: Any provider creating AI-generated content for public

What: Must label content as AI-generated

Examples:

  • AI-written news articles → "Generated by AI" label
  • AI social media posts → disclosure
  • AI marketing emails → disclose
  • YouTube videos (AI voice) → label

Instagram/TikTok impact: AI-generated videos must show label

Rule 3: Emotion Recognition Rules

Who: Companies using emotion recognition AI

What: Must inform users when emotion AI active

Examples:

  • Job interview AI (analyzing facial expressions): Must disclose
  • Retail stores (customer mood tracking): Inform customers
  • Call centers (voice emotion analysis): Tell callers

Kerala companies: BPO/call centers using emotion AI → EU clients → compliance needed!

Rule 4: Deepfake Disclosure

Who: Anyone creating deepfakes or AI-generated images of real people

What: Clearly mark as synthetic/AI-generated

Critical: Public interest content (news, politics, satire) → extra strict rules

Examples:

  • AI face swap videos → "Deepfake" label mandatory
  • AI politician images → label
  • Satire OK → but must be clearly labeled satire

Penalties
